Sullivan & Cromwell’s AI Missteps in Court

Sullivan & Cromwell, a prominent U.S. law firm, publicly acknowledged errors in a court filing generated by artificial intelligence, revealing significant inaccuracies and fabricated citations. The firm issued an apology in a letter to a federal judge on April 18, highlighting the need for heightened scrutiny of AI usage in legal practices.

The errors, which totaled nearly 40 inaccuracies including nonexistent legal citations, were uncovered during litigation in U.S. Bankruptcy Court in Manhattan. Partner Andrew Dietderich, co-head of the firm’s global finance and restructuring group, disclosed these issues after opposing counsel from Boies Schiller Flexner identified the discrepancies. Sullivan & Cromwell emphasized that despite having a clear protocol designed to mitigate risks associated with AI, these safeguards failed to prevent the submission of a flawed document, sparking a wider dialogue about the reliability of AI in legal settings.

Nature of the Errors and Immediate Reactions

The incident underscores a growing concern regarding “AI hallucinations,” a phenomenon where AI models produce incorrect or fictitious information. In this case, the errors included fabrications of case citations and misrepresentations of legal statutes. Although Sullivan & Cromwell admitted that some of the inaccuracies stemmed from clerical errors unrelated to AI, the dominance of AI-related issues led to a reinforced narrative cautioning against uncritical reliance on such technology in legal frameworks.

Dietderich’s letter to Judge Martin Glenn stressed the firm’s commitment to rigorous oversight and professional judgment. He disclosed, “We have comprehensive policies and training requirements governing the use of AI tools in legal work. These requirements are clearly reinforced in the firm’s Office Manual for Lawyers.” The firm’s standards necessitate that attorneys independently verify all outputs from AI tools prior to submitting documents to courts or regulators, indicating that adherence to these guidelines may not have been sufficiently enforced.

This situation has raised alarms within the broader legal community, prompting discussions surrounding the integration of AI in legal practices. With a growing number of firms using AI for drafting and research, concerns about the potential risks of misinformation and errors are becoming more pronounced. Industry experts argue that a collective reevaluation of AI utilization protocols may be necessary to safeguard the integrity of legal proceedings.
