Argentina Takes Action Against Unregulated Betting Platforms
A Buenos Aires City Court mandated on March 16, 2026, a nationwide ban on the cryptocurrency-based betting platform Polymarket, citing its operation as an unregulated gambling site without necessary licenses. The directive instructs the telecom regulator ENACOM to ensure that internet service providers block access to Polymarket and demands the removal of the app from major platforms like Google and Apple.
The court’s ruling stems from complaints raised by the Lotería de la Ciudad de Buenos Aires and the Argentine Chamber of Casinos, Bingos and Annexes (CASCBA), asserting Polymarket’s lack of legitimate gambling licenses. According to prosecutors, the platform operated as a “concealed online betting system,” allowing users to create accounts swiftly without identity verification, which poses risks of underage gambling as well as financial losses from unregulated betting.
Concerns Over Regulatory Compliance
Judge Susana Parada expressed particular concern over Polymarket’s acceptance of both cryptocurrency and credit card payments without adequate oversight. The ruling was prompted in part by a specific incident involving $91,000 in bets related to Argentina’s February inflation data made shortly before the official release by INDEC, which raised suspicions about the use of undisclosed information.
Proponents of the ban argue that the ruling sets a significant precedent in Argentina, marking it as the first country in Latin America to restrict access to a prediction market platform like Polymarket. This represents a broader trend of increasing regulatory scrutiny over the burgeoning online gambling sector in the region. Licensed operators have criticized how unregulated platforms undermine the legitimacy of their businesses and leave consumers exposed to risks.
As the ban rolls out, it reflects ongoing tensions between the impulse for regulatory oversight in gambling and the growing appeal of cryptocurrency for online betting. The digital space has been grappling with whether it is a legitimate avenue for entertainment or an unregulated risk. Policymakers in Argentina are considering legislation to entirely prohibit crypto-based betting, which indicates a significant shift in sentiment towards the mainstream acceptance of cryptocurrency.
Looking Ahead: Regulatory Landscape and Enforcement Challenges
The next steps for enforcement of this ban will involve monitoring compliance among internet service providers and the tech platforms involved with Polymarket. This could lead to legal battles as the platform might seek to challenge the ruling in higher courts, complicating the enforcement landscape. Such scenarios may repeatedly test the boundaries of local regulations as the global nature of cryptocurrencies often transcends national jurisdictions.
This move signals how digital financial services, especially those involving cryptocurrencies, may face an uphill battle in gaining acceptance without firm regulatory frameworks in place. The legal framework around online gambling and cryptocurrencies seems poised for significant evolution, with other jurisdictions likely to observe Argentina’s actions closely as they consider their own regulations.
