Michael Smith, a North Carolina musician, pleaded guilty on March 19-20, 2026, to conspiracy to commit wire fraud, having orchestrated an elaborate scheme to generate over $8 million in fraudulent music streaming royalties using artificial intelligence and automated bots. Smith’s fraudulent activities, which spanned from 2017 to 2024, saw him create hundreds of thousands of AI-generated songs. He then employed bots to stream these tracks billions of times on platforms like Spotify, Apple Music, Amazon Music, and YouTube Music, effectively siphoning royalty payments intended for legitimate artists. According to prosecutors, his actions resulted in a staggering collection of $8,091,843.64, which he has agreed to forfeit. U.S. Attorney Jay Clayton characterized the scheme as “brazen,” directly stealing money from deserving musicians through deceptive practices.

How the Fraud Worked

Smith utilized a complex web of AI-generated music purchased from accomplices, including the CEO of an AI music company and a promoter whose identity remains undisclosed. He deployed thousands of bot accounts, concealing their activities through the use of virtual private networks (VPNs) to evade detection by music streaming services. This loophole in the systems allowed for inflated stream counts, misleading revenue distribution among artists reliant on accurate streaming data for their livelihoods.

The legal ramifications of this case are significant; Smith faces up to five years in prison, with sentencing scheduled for July 29, 2026. Based on the prosecution’s recommendations, Smith may also undergo three years of supervised release following imprisonment and face a $250,000 fine. The Music Licensing Collective (MLC) has highlighted this prosecution as a landmark case in the fight against AI-assisted streaming fraud, showcasing the vital need for enhanced monitoring and regulatory measures in the digital music industry.
